Terms of Service

Effective date: July 9, 2026.

1. Agreement

These Terms of Service (“Terms”) govern your use of the Evidal platform — the websites, APIs, and services operated by Random Artifact, Inc., a Delaware corporation(“Evidal”, “we”). By creating an account, submitting an application, or otherwise using the platform, you agree to these Terms and to our Privacy Policy. If you use Evidal on behalf of a company, you confirm you have authority to bind that company.

2. What Evidal Is (and Is Not)

Evidal is an evaluation platform for hiring. Candidates apply through a structured conversation (directly or via an AI agent acting on their behalf); Evidal then runs an internal, AI-assisted evaluation and produces structured scores and written summaries for the hiring company.

Evidal produces screening recommendations — signals to help a company decide whom to advance to interviews. Evidal does not make hiring decisions, and its output is not a hiring decision.

  • Hiring companies remain solely responsible for every employment decision (advance, interview, reject, hire) and for complying with the employment, anti-discrimination, and automated-decision laws that apply to them.
  • Evaluations are produced with the assistance of AI models. They are probabilistic assessments of the evidence a candidate presented — they can be incomplete or wrong, and we say so to companies. They must be used as one input among several, never as the sole basis for an adverse decision.
  • Evidal does not guarantee candidates any interview, role, or outcome, and does not guarantee companies any particular candidate quality or hiring result.

3. Accounts

  • You must provide accurate information when creating a company account or submitting an application.
  • You are responsible for safeguarding your credentials and API keys, and for the activity that occurs under them. Tell us promptly at support@evidal.ai if you suspect unauthorized use.
  • We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Acceptable Use

You agree not to:

  • Submit fabricated experience, impersonate another person, or misrepresent who (or what) is answering in an evaluation beyond the disclosed use of an AI assistant.
  • Probe, game, or attempt to manipulate the evaluation system, including prompt-injection against our bots.
  • Scrape, bulk-extract, or attempt to access data about other candidates or other companies.
  • Use candidate data obtained through Evidal for any purpose other than evaluating that candidate for the role they applied to.
  • Use the platform to discriminate unlawfully, or in violation of any applicable law.
  • Circumvent rate limits, access controls, or billing.

5. Payments

  • Payments are processed by Stripe. Evidal does not store full payment-card details.
  • Companies pay for evaluation capacity (per-evaluation or subscription pricing, as presented at purchase) and for lead unlocks— a one-time fee to reveal a candidate's identity and contact details for an application to that company. Candidates never pay to apply.
  • Fees are stated before you confirm a charge. Except where required by law or expressly stated otherwise, fees are non-refundable once the paid-for service (an evaluation, an unlock) has been delivered.
  • You are responsible for applicable taxes.

6. Candidate Data

How we collect, use, share, retain, and delete candidate data — including who can see what, how identity unlocks work, and how to delete your data — is described in the Privacy Policy, which is part of these Terms. Companies receiving candidate data through Evidal must protect it and use it only for recruitment for the role applied to.

7. Intellectual Property

  • The platform, evaluation methodology, and scores are Evidal's. You receive a limited, non-exclusive right to use them as part of the service.
  • You keep ownership of the content you submit. You grant Evidal the license needed to operate the service: to process your submission, run evaluations, and show the results to the company you applied to.

8. Disclaimers

The platform is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that evaluations are error-free or that the service will be uninterrupted.

9. Limitation of Liability

To the maximum extent permitted by law: (a) Evidal is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data; and (b) Evidal's total liability for any claim arising out of the service is limited to the greater of the amounts you paid Evidal in the 12 months before the claim and USD $100. Some jurisdictions do not allow these limits; where that is the case they apply to the fullest extent permitted.

10. Termination

You may stop using the service at any time; candidates may additionally delete their data as described in the Privacy Policy. We may suspend or terminate access for breach of these Terms. Sections 7–9 and 11–12 survive termination.

11. Changes to These Terms

We may update these Terms. For material changes we will give notice (e.g. on this page, by email, or in the dashboard) before the change takes effect. Continued use after the effective date of a change constitutes acceptance. The current version always lives at this URL.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Venue for disputes is the state and federal courts located in Delaware, USA.
